Welcome to Bam Good Time

By accessing or using our website and services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

Events and Registration

• Event registration is subject to availability and may require advance payment for certain events
• Cancellation policies vary by event type - please check individual event details
• We reserve the right to cancel or reschedule events with reasonable notice
• Refunds for cancelled events will be processed within 5-10 business days
• Participants are expected to conduct themselves respectfully at all events

Shop and Purchases

• All purchases are processed securely through Shopify
• Prices are listed in USD and are subject to change without notice
• Shipping times and costs vary by location and are displayed at checkout
• All sales are final. Items cannot be returned or exchanged for change of mind
• If an item arrives defective, damaged, or is not what you ordered, we will replace or refund it and cover shipping both ways

User Accounts

• You are responsible for maintaining the security of your account
• You must provide accurate information when creating an account
• We reserve the right to suspend or terminate accounts that violate these terms
• You may request deletion of your account at any time

SMS/Text Messaging Terms (Club & Event Notifications)

By providing your phone number during account creation, registration, or when invited by a club administrator, you consent to receive transactional SMS messages from Bam Good Time related to your club membership and event participation.

Consent

Your consent to receive SMS messages is obtained when you:

• Create an account and provide your phone number
• Verify your phone number during registration
• Are added to a club by an administrator (you will receive an invitation message with opt-out instructions)

Message Types

These club and event messages are transactional and include: account invitations, event reminders, check-in confirmations, table assignments, game results, waitlist updates, and verification codes. Promotional and marketing text messages are offered only through our separate, opt-in shop program (restock alerts and promotions) described in the section below, which requires its own consent.

Frequency and Costs

Message frequency varies based on your event participation (typically 1-5 messages per event). Message and data rates may apply based on your mobile carrier plan.

Opting Out

You may opt out at any time by replying STOP to any message. After opting out, you will receive a confirmation and no further messages. To resubscribe, reply START. For help, reply HELP or visit our contact page.

Privacy

Your phone number and SMS consent information are not sold, rented, or shared with third parties for marketing purposes. See our Privacy Policy for complete details on how we handle your information.

SMS / Text Messaging Terms (Marketing: Shop Restock & Promotions)

These terms apply to the marketing and restock text messages you can opt in to through our online shop's "Notify me when back in stock" form. They are separate from the transactional club and event messages described in the section above, and you consent to each program separately.

Program Description

By opting in, you agree to receive text messages from Bam Good Time, including restock alerts for products you request and occasional promotional messages about restocks, new products, and sales.

Frequency, Rates, and Keywords

• Carriers are not liable for delayed or undelivered messages.

Consent

Consent to receive marketing text messages is not a condition of any purchase. You provide this consent through a separate, unchecked opt-in, and you may withdraw it at any time by replying STOP.

Intellectual Property

What we own

The Bam Good Time platform itself — the software, source code, database design, page layouts, workflows, visual design, our logos and brand names (including Bam Good Time, Mahjic, Mahjic Rating, and Mahjic Verified), and any text, graphics, or images we ourselves create — is our property or our licensors’, and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from it without our express written permission.

What you own

You keep it. Everything you upload, post, or publish through the platform — your club name and logo, your event descriptions and photographs, your lesson plans, curricula, handouts and teaching materials, your newsletters, your member lists, your scores and records (“Your Content”) — remains yours. We claim no ownership of it, and nothing in these terms transfers or assigns any copyright in it to us.

For the avoidance of doubt: Your Content is not a work made for hire. You are not our employee or contractor by reason of using the platform, we do not commission Your Content, and no part of these terms is an agreement to treat it as a work made for hire.

So that we can actually run the service, you grant us a non-exclusive, worldwide, royalty-free licence to host, store, copy, reformat, transmit, and display Your Content solely for the purpose of operating and supporting the platform for you — showing your event page to your members, sending the emails you ask us to send, generating your standings, backing up your data, and providing support when you ask for it. This licence exists only to make the product work. It ends for future use when you delete the content or close your account, save for backup copies retained for a reasonable period and any copies your own members have already lawfully received.

We do not sell Your Content, license it to anyone else, or make it available to other clubs or to enterprise customers for their own use. Where content you publish is public by its nature — a public event listing, a public club page, a directory entry you have asked us to create — it is visible publicly because you published it, and we may show it in those public surfaces and in search results accordingly.

Your responsibility for what you upload

Because Your Content is yours, responsibility for it is yours too. You represent and warrant that you own Your Content or have all rights and permissions necessary to publish it through the platform, and that it does not infringe any copyright, trademark, trade secret, privacy, publicity, or other right of any third party. We do not pre-screen, review, or verify Your Content.

You agree to indemnify, defend, and hold harmless Bam Good Time and its owners, officers, and staff from any claim, demand, loss, liability, damage, cost, or expense (including reasonable legal fees) arising out of or relating to Your Content, your use of the platform, or your breach of these terms.

Copyright complaints

We respect the intellectual property rights of others and expect our users to do the same. If you believe material on the platform infringes your copyright, send a written notice to mahjong@bamgoodtime.com identifying the copyrighted work, identifying the material you say is infringing and where it appears on the platform, your contact details, a statement that you believe in good faith that the use is not authorised, and a statement that the information in your notice is accurate and that you are the rights holder or authorised to act for them.

We will remove or disable material we reasonably believe to be infringing, and we may terminate the accounts of users who repeatedly infringe. If your material was removed and you believe that was a mistake, you may send a counter-notice to the same address.

Acceptable Use of the Platform

By accessing the Bam Good Time platform (including bamgoodtime.com, its subdomains, the Mahjic desktop and mobile applications, and any associated APIs), you agree that you will not:

• Reverse engineer, decompile, disassemble, or attempt to derive the source code, algorithms, or trade secrets of the platform
• Copy, scrape, replicate, or build competing products that incorporate the design, features, workflows, or branding of the platform
• Use any robot, spider, scraper, or automated means to access or collect data from the platform except for permitted public-facing search engine indexing
• Use accounts — including beta, founder, free-for-life, or complimentary accounts — to provide consulting, white-label, or resold services to third parties without a written commercial agreement with Bam Good Time
• Bypass or attempt to bypass any access controls, rate limits, or security measures
• Use the platform to harvest contact information, member lists, or club data for use outside Bam Good Time

We may suspend or terminate any account that we reasonably believe has violated this section, and may pursue any other remedies available under applicable law.

Disclaimer of Warranties

The platform is provided “as is” and “as available”, without warranty of any kind. To the maximum extent permitted by law we disclaim all warranties, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the platform will be uninterrupted, timely, secure, or error-free, that any data will be free of loss or corruption, or that any result obtained through it — a rating, a standing, a seating chart, a report, a total — will be accurate or complete. You are responsible for keeping your own records of anything that matters to you.

Content published by clubs, organizers, and other users is theirs, not ours. We do not endorse it and are not responsible for it.

Events Are Run by Clubs, Not by Us

Except for events we expressly state are our own, Bam Good Time is a platform that clubs and organizers use to run their events. We are not the organizer, host, promoter, or operator of those events, we do not select or supervise their venues, staff, or participants, and we are not a party to any agreement between a club and its members.

Responsibility for an event — including the venue and its condition, safety, supervision, insurance, permits, refunds, conduct at the table, and anything that happens before, during, or after it — rests with the club or organizer running it. Any dispute about an event is between you and them.

Limitation of Liability

To the maximum extent permitted by law, Bam Good Time is not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunity, arising from or relating to your use of the platform — whether the claim is brought in contract, tort (including negligence), strict liability, or otherwise, and whether or not we were advised such damages were possible.

Our total aggregate liability for all claims relating to the platform is limited to the greater of the amount you paid us for the specific service or product giving rise to the claim in the twelve months before the claim arose, or one hundred US dollars. Some jurisdictions do not allow certain exclusions or limitations, so parts of this section may not apply to you; where that is so, our liability is limited to the smallest extent permitted by law.

Code of Conduct

We are committed to providing a welcoming environment for all. At our events, we expect participants to:

• Treat all players with respect and courtesy
• Follow the rules of American Mahjong as established for each event
• Refrain from disruptive or inappropriate behavior
• Report any concerns to event organizers

Changes to Terms

We may update these terms from time to time. Continued use of our services after changes constitutes acceptance of the new terms. We will notify users of significant changes via email or website announcement.
